Agreement to Terms

By downloading, installing, or using Nail Shape AI (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Azulheim ("we," "us," or "our"). The App is licensed, not sold, to you for use strictly in accordance with these Terms.

1. Description of Service

Nail Shape AI is a mobile application that uses artificial intelligence to analyze your nails and hands from photos you provide. The App delivers a comprehensive, personalized nail analysis across 21 sections, including:

Nail shape classification and overall hand & nail rating
Nail health assessment — condition, strength, and health indicators
Finger-by-finger breakdown and hand proportion analysis
Most flattering nail shapes and shapes to avoid based on your fingers
Nail length sweet spot recommendations
Best nail shapes for different occasions
Skin tone analysis and color recommendations
Nail art style recommendations
Jewelry and hand styling guidance
Nail superpowers, weaknesses, and hand glow analysis
Personalized nail care routines and product recommendations
Nail goals roadmap, salon vs. DIY guidance, and lifestyle tips

Important: The App is designed for personal care and educational purposes only. Results are AI-generated estimates and should not be considered professional nail technician, dermatological, or medical advice.

2. Subscriptions & Purchases

Premium Features

Certain features of the App require a paid subscription purchased through Apple's In-App Purchase system. Subscription options may include:

Weekly Subscription: Automatically renews every week
Monthly Subscription: Automatically renews every month
Yearly Subscription: Automatically renews every year

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. You will be charged for renewal within 24 hours prior to the end of the current period at the same price you initially paid.

Managing Subscriptions

You can manage or cancel your subscription at any time through your Apple ID Account Settings. Cancellation takes effect at the end of the current billing period.

Free Trials

If offered, free trial periods automatically convert to paid subscriptions unless canceled before the trial period ends. Unused portions of free trial periods are forfeited when you purchase a subscription.

Refunds

All purchases are processed through Apple. We do not control Apple's refund policies. For refund requests, contact Apple Support directly. We cannot provide refunds for purchases made through the App Store.

Payment Processing: All payment information is handled exclusively by Apple. We never receive or store your payment details.

3. Privacy & Data Handling

We have designed the App with privacy-first principles. Here is how we handle your data:

No Photo Storage: Photos of your hands and nails are immediately deleted after AI analysis is complete
No Personal Data Collection: We do not collect names, emails, or any identifying information
Local Storage Only: Analysis results and your history are stored exclusively on your device, not on our servers
No Tracking: We do not use analytics, cookies, or tracking technologies
Encrypted Transmission: Photos are transmitted using HTTPS encryption for processing

4. Disclaimers & Limitations

Results are AI-generated estimates for personal care and educational purposes only. For nail or skin health concerns, consult a qualified healthcare or beauty professional.

No Guarantees

Results are estimates based on AI visual analysis and may not be fully accurate
We do not guarantee specific nail care or styling outcomes from following recommendations
Analysis accuracy depends on photo quality, lighting, angles, and other factors
AI technology has inherent limitations and may produce unexpected or incorrect results
Product recommendations are general suggestions — individual results may vary

Personal Care Purpose

The App is designed to help you understand your unique nail shape and hand characteristics, and explore style and care strategies through shape selection, nail art, product choices, and lifestyle adjustments. Recommendations are suggestions, not prescriptions for professional treatments or procedures.

Product & Allergy Disclaimer

Always patch-test new nail products before full use. We are not responsible for any adverse reactions to products recommended by the App. Consult a professional if you have known skin sensitivities or nail conditions.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

Upload photos of individuals without their consent
Use the App to harass, abuse, or harm others
Upload photos of minors (under 13 years old) without parental consent
Use the App for any illegal or unauthorized purpose
Attempt to reverse engineer, decompile, or hack the App
Use automated systems or bots to access the App
Circumvent any security features or access restrictions
Upload malicious code, viruses, or harmful content
Use analysis results for commercial purposes without written permission
Resell, redistribute, or sublicense the App or its features

Photo Consent: You confirm that you have the right to upload and analyze any photos you submit to the App. You are responsible for ensuring you have proper consent for any photos containing identifiable individuals.

6. Intellectual Property

App Ownership

All rights, title, and interest in the App, including all software, designs, text, graphics, and other content, are owned by Azulheim or its licensors. Your use of the App does not grant you ownership of any intellectual property rights.

User Content

You retain all rights to photos you upload. Since we immediately delete your photos after processing, we do not store or use your photos for any purpose beyond generating your nail analysis.

Analysis Results

Analysis results generated by the App are for your personal, non-commercial use. You may share results on social media or with others, but you may not use results for commercial purposes without our written permission.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
Our total liability shall not exceed the amount you paid for subscriptions in the last 12 months (or $100 USD if greater)
We are not responsible for any nail care or styling decisions you make based on App results
We are not liable for inaccurate or misleading results generated by the AI
We are not responsible for any adverse reactions to recommended products or routines
We are not liable for any third-party claims arising from your use of the App
We are not responsible for data loss, service interruptions, or technical errors

No Warranties: The App is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Apple Terms & Requirements

Licensed Application

This license is between you and Azulheim, not Apple Inc. Apple is not responsible for the App, its content, maintenance, support services, warranty claims, or any third-party claims relating to the App.

Apple's Role

Apple has no obligation to provide maintenance or support services
Apple is not responsible for addressing any claims relating to the App
Apple is not responsible for product liability claims
In case of third-party intellectual property infringement, Apple is not liable
Apple and its subsidiaries are third-party beneficiaries of this agreement

9. Indemnification

You agree to indemnify, defend, and hold harmless Azulheim, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms of Service
Your violation of any rights of another person or entity
Any content you upload to the App
Any decisions you make based on App results

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms.

Effect of Termination

Your right to use the App will immediately cease
Active subscriptions may be canceled (refunds subject to Apple's policies)
Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination

11. Governing Law & Disputes

Governing Law

These Terms are governed by the laws of the jurisdiction where Azulheim is based, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App should first be resolved through good faith negotiations. If informal resolution fails, disputes will be resolved through binding arbitration or in courts of competent jurisdiction, as required by applicable law.

Class Action Waiver

You agree to resolve disputes with us only on an individual basis, and you waive the right to bring or participate in any class action or representative proceeding.

12. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting the updated Terms in the App or on our website.

Notification: We will notify users of significant changes through app updates or in-app notifications

Acceptance: Your continued use of the App after any changes constitutes acceptance of the updated Terms

Disagreement: If you don't agree with the updated Terms, stop using the App and cancel your subscription

13. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Azulheim regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.

Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services.
