1. Service Overview

AI-Powered Ancestry Analysis: Ethnicity AI uses artificial intelligence to analyze facial features from your photos and provide estimates about potential ancestry and ethnic origins.

Free & Premium Features

Free Analysis: Users receive one free ancestry analysis including primary ancestry, regional breakdown, and eye analysis
Premium Features: Unlimited analyses, skin tone analysis, detailed insights, and access to 15+ additional features

Premium features require a subscription purchased through the Apple App Store.

2. Subscriptions

Auto-Renewable Subscriptions: Premium features require a subscription purchased through the Apple App Store.

Subscription Plans

Weekly: Automatically renews every week
Monthly: Automatically renews every month
Yearly: Automatically renews every year

Auto-Renewal & Cancellation

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You will be charged within 24 hours prior to the end of the current period. Manage or cancel subscriptions in your Apple Account Settings. No refunds for unused portions of any subscription period.

Free Trials

If offered, free trials convert to paid subscriptions unless canceled before the trial ends. Trial eligibility is determined by Apple and limited to one per user. Your free analysis is separate from any free trial offers.

Refunds

All purchases are processed through Apple. For refund requests, contact Apple Support directly. We cannot process refunds independently of Apple's systems.

3. Privacy & Data Protection

Zero Photo Storage: We do not store your photos or create user accounts. Photos are analyzed by AI and immediately deleted after processing.

How Your Data is Handled

Encrypted Transmission: Photos are encrypted during transmission to our AI processing servers
Immediate Deletion: Photos are permanently deleted from our servers within seconds after analysis is complete
Local Storage Only: Analysis results are stored only on your device, not on our servers
No Account Required: The app does not require account creation or personal information
No Tracking: We do not track your usage patterns or store your analysis history

ENTERTAINMENT & EDUCATIONAL PURPOSE ONLY: This App provides AI-based estimates for entertainment and educational purposes. It is NOT a substitute for professional genealogical research or DNA testing.

Not DNA Testing

Ethnicity AI does NOT perform genetic testing or DNA analysis. All results are based solely on visual analysis of facial features using artificial intelligence. Results are estimates and should not be treated as definitive statements about your genetic ancestry.

Accuracy Limitations

Results are AI-generated estimates based on visual patterns, not genetic testing
Accuracy may vary based on photo quality, lighting, angles, and facial features
Results may not accurately reflect your true genetic ancestry or ethnic background
We make no guarantees about the accuracy, completeness, or reliability of analysis results
Individual results may vary significantly from actual ancestry

We respect all cultures, ethnicities, and backgrounds. This app is designed to celebrate human diversity and heritage, not to stereotype or categorize individuals. If you find results offensive or inaccurate, please remember this is AI-generated entertainment content.

No Professional Advice

This app does not provide professional genealogical, genetic counseling, medical, legal, or any other professional advice. For accurate ancestry information, consult professional DNA testing services or genealogical researchers.

Service Availability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We reserve the right to modify, suspend, or discontinue the App or any features at any time without prior notice or liability.

5. Acceptable Use

You Agree NOT To:

Use the app for any illegal, harmful, or discriminatory purposes
Upload photos of other people without their explicit consent
Upload photos of minors (under 18 years old)
Use results to discriminate against or harass any individual or group
Present AI-generated results as scientifically validated ancestry information
Attempt to reverse engineer, decompile, or hack the app
Use the app in any way that violates applicable laws or regulations
Share or distribute offensive, harmful, or inappropriate content

Photo Consent: You confirm that you have the right to upload and analyze any photos you submit to the app. You are responsible for ensuring you have proper consent for any photos containing identifiable individuals.

6. Intellectual Property

App Ownership

All rights, title, and interest in the App, including all software, designs, text, graphics, and other content, are owned by Azulheim or its licensors. Your use of the App does not grant you ownership of any intellectual property rights.

User Content

You retain all rights to photos you upload. However, since we immediately delete your photos after processing, we do not store or use your photos for any purpose beyond generating your analysis.

Analysis Results

Analysis results generated by the app are for your personal, non-commercial use. You may share results on social media or with others, but you may not use results for commercial purposes without our written permission.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App
Our total liability shall not exceed the amount you paid for subscriptions in the last 12 months (or $100 USD if greater)
We are not responsible for any decisions you make based on app results
We are not liable for inaccurate, offensive, or misleading results generated by the AI
We are not responsible for any emotional distress, identity issues, or other psychological impacts from using the app
We are not liable for any third-party claims arising from your use of the app
We are not responsible for data loss, service interruptions, or technical errors

No Warranties: The app is provided without any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

8. Apple Terms & Requirements

Licensed Application

This license is between you and Azulheim, not Apple Inc. Apple is not responsible for the App, its content, maintenance, support services, warranty claims, or any third-party claims relating to the App.

Apple's Role

Apple has no obligation to provide maintenance or support services
Apple is not responsible for addressing any claims relating to the App
Apple is not responsible for product liability claims
In case of third-party intellectual property infringement, Apple is not liable
Apple and its subsidiaries are third-party beneficiaries of this agreement

9. Indemnification

You agree to indemnify, defend, and hold harmless Azulheim, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the App
Your violation of these Terms of Service
Your violation of any rights of another person or entity
Any content you upload to the App
Any decisions you make based on app results

10. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms.

Effect of Termination

Your right to use the App will immediately cease
Active subscriptions may be canceled (refunds subject to Apple's policies)
Provisions regarding intellectual property, disclaimers, and limitations of liability survive termination

11. Governing Law & Disputes

Governing Law

These Terms are governed by the laws of the jurisdiction where Azulheim is based, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App should first be resolved through good faith negotiations. If informal resolution fails, disputes will be resolved through binding arbitration or in courts of competent jurisdiction, as required by applicable law.

Class Action Waiver

You agree to resolve disputes with us only on an individual basis, and you waive the right to bring or participate in any class action or representative proceeding.

12. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting the updated Terms in the App or on our website.

Notification: We will notify users of significant changes through app updates or in-app notifications

Acceptance: Your continued use of the App after any changes constitutes acceptance of the updated Terms

Disagreement: If you don't agree with the updated Terms, stop using the App and cancel your subscription

13. Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Azulheim regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations under these Terms without restriction.

Third-Party Services

The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of any third-party services.
